If you hook up to a vehicle and take it, it’s considered vehicle theft. You will be prosecuted,” a deputy told the tow truck driver. “The next time you try to take another vehicle, our supervisor said you will be prosecuted for vehicle theft,” the sheriff told the driver.

You’ve stolen a dozen cars already and fraudulently extorted your victims for release fees we’re letting you keep…

But it’s not like you sold a single lose cigarette so you just better not do it again.

    /S

Almost like cops treat a business differently than they do a person…

They probably rely on those tow companies to enforce their tickets. There is probably a kick-back scheme going too. Only thing that would surprise me is if any of these tow drivers/owners, actually get arrested and charged, rather than just ignored, if they continue doing it.

A nice civil case against the tow driver and company will sting pretty badly.

I’d add everyone in the HOA to that civil suit, too. Make them all pay.

A dozen civil suits against all of them will hurt.

Sue the HOA too, seek a permanent injunction requiring them to get permission from the court before towing, and forcing them to adopt rules changes. Prevent them from doing it again.

Agreed. Read your HOA docs and see if you agreed to allow them on your private property. I sued mine once and they paid me.

Did they then add a ‘legal fees’ line item to your maintenance invoice though?
