Yeah they need to remove the question mark, of fucking course they do. Any meaningful question should be is it “cruel and unusual” to force these environmental prisoners to clean up toxic environmental waste for the rest of their lives?
Never heard of it happening, so I’m going to go with “no”. Whenever it comes up, it’s always just a “cost of doing business” type of scenario where the eventual fine and damages don’t outweigh the potential gains, which means they all do it and will continue doing it.
